The petitioner apprehends his arrest in Lakhisarai P.S. Case No.232 of 2017 registered under Sections 272 and 273 of the Indian Penal Code and under Sections 30(a)(c)(d), 32(c), 34(iv), 36, 38(a) of Bihar Prohibition and Excise Act. The police raided a place situated outside the village and seized 5 liters country made liquor. Police apprehended five persons who disclosed that the petitioner was also there but he managed to flee away.
The learned counsel for the petitioner submits that the petitioner was not apprehended on the spot and nothing has been recovered from the possession of the petitioner. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the
Patna High Court Cr.Misc. No.75996 of 2018(2) dt.21-12-2018 2/2 court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J. 2nd -cum-Special Judge, Excise, Lakhisarai in connection with Lakhisarai P.S. Case No.232 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
