2. The petitioner seeks bail in connection with Lalganj P.S. Case No. 176/2019 registered for the offence punishable under Sections 302/341/504/506/34/120B of the Indian Penal Code and Section 27 of the Arms Act.
3. The wife of the deceased was killed by unknown criminals. Subsequently, during investigation one Varun Kumar has confessed his guilt and named the other accused persons, namely, Varun Kumar, Ranjeet Kumar and Abdul Qayum who have been granted bail vide orders dated 15.09.2023 passed in Cr. Misc. No. 62101 and 2023, dated 28.07.2023 passed in Cr. Misc. No. 45510 and 2023 and dated 04.12.2019 passed in Cr. Misc. No. 62772 and 2019 respectively. The petitioner is in jail
Patna High Court CR. MISC. No.75161 of 2023(3) dt.27-02-2024 2/2 since 10.04.2023.
4. Considering the fact that similarly situated coaccused have been granted bail, this application is allowed.
5. Let the petitioner above named be released on bail after framing of charge if charge not already framed, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate XIV, Vaishali at Hajipur in connection with Lalganj P.S. Case No. 176/2019.
6. The petitioner is directed to mark his attendance in Kartahan police station on every Sunday of the month. Failure to do so, will result in cancellation of bail bond of the petitioner. (Sandeep Kumar, J) Saif/- U T
