2. The petitioner seeks bail in connection with Motihari (Town) P.S. case No. 465 of 2023 instituted for the offences under Sections 341, 323, 324, 307, 379, 504/34 of the Indian Penal Code.

3. It is alleged that this petitioner assaulted and gave knife blow on the waist of the son of the informant causing serious injury.

4. It has been submitted on behalf of the petitioner that the petitioner is in custody since 05.07.2023. He further submitted that the date of custody has wrongly been typed as

Patna High Court CR. MISC. No.74765 of 2023(2) dt.02-12-2023 2/2 07.07.2023 in impugned order. The petitioner has one criminal antecedent in which he is on bail. The petitioner has falsely been implicated in the present case.

5. Learned A.P.P. for the State and learned advocate for the informant have vehemently opposed the prayer for grant of bail to the petitioner and submitted that the injury caused by the petitioner is grievous in nature which is already mentioned in the order of the lower Court.

6. Considering the aforesaid facts and circumstances of the case, the nature of injury as also the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Motihari (Town) P.S. case No. 465 of 2023.
