The petitioner has been in custody since 15.10.2018 in connection with Excise Case No. 230 of 2018 registered for the offense punishable under Sections 30(a) of Bihar Prohibition and Excise Act.
Learned counsel for the petitioner submits that the alleged recoveries were made from a tempo on which the petitioner was travelling. It is submitted that he has no criminal antecedent and in view of the fact that the recoveries were not made from his conscious possession, the petitioner may be extended the privilege of bail.
In view of the aforementioned facts and
Patna High Court Cr.Misc. No.76914 of 2018(2) dt.10-01-2019 2/2 circumstances, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-II cum Special Judge, Excise, Gopalganj, in connection with Excise Case No. 230 of 2018.
