JUSTICE ARVIND SRIVASTAVA ORAL ORDER 06-02-2020 At the outset, learned counsel for the petitioner submits that during pendency of this application petitioner no. 1 has been arrested, and as such, he seeks permission to withdraw this application as against him.

In view of the above, this application stands dismissed as withdrawn as against petitioner no. 1, Bablu Kumar.

Heard learned counsels for the petitioner and the State.

Petitioner apprehends arrest in connection with 127C 2 of 2019 registered for the offence punishable under sections 30(a) of the Bihar Prohibition and Excise Act.

Nothing has been recovered from the conscious possession of this petitioner. Petitioner has no concern with the alleged illicit liquor. Petitioner has no criminal antecedent.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-cum-special Judge, Excise Act, Begusarai in connection with Case No. 127C 2 of 2019 subject to the conditions laid down under section 438(2) Cr.P.C.
