2. The petitioner seeks bail in connection with Raghopur P.S. Case No. 424/2024 registered for the offences punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 109, 303(2), 352 of the Indian Penal Code and later on vide order dated 23.04.2025 Section 103(1) of B.N.S. was added.
3. As per the prosecution case, petitioner along with other persons have brutally assaulted the deceased.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in the present case. Learned counsel for the petitioner submits that from the postmortem report the allegation levelled against the petitioner in the FIR is not supported. The informant was assaulted on
Patna High Court CR. MISC. No.68997 of 2025(5) dt.18-12-2025 2/2 16.12.2024 and he died during the course of treatment. Learned counsel further submits that petitioner is not the assailant of the victim and no offence under Section 305 is made out in the case. Learned counsel further submits that petitioner is a man with a clean antecedent and he is in custody since 24.04.2025. The petitioner undertakes to co-operate in the case/ trial.
5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.
6. Considering the facts and circumstances of the case, this application for regular bail is allowed.
7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Birpur, Supaul/concerned Court below in connection with Raghopur P.S. Case No. 424 of 2024.
