Petitioner is in custody in connection with Harsidhi P.S. Case No. 330 of 2018 for the offence under sections 399 and 402 of the Indian Penal Code.

Learned counsel for the petitioner submits that nothing was recovered from the possession of the petitioner and the petitioner is in custody since 29.8.2018. Referring to the case of similarly circumstanced coaccused Varun Singh who has been granted bail in Cr. Misc. No. 73217 of 2018 vide order dated 7.12.2018 he submits that the case of this petitioner is identical to the case of Varun Singh and as such the petitioner deserves similar treatment. Considering the aforesaid, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.77195 of 2018(2) dt.10-01-2019 2/2 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari, in connection with Harsidhi P.S. Case No. 330 of 2018.
