JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-01-2019 This application, for grant of anticipatory bail, arises out of Lakhnour (R.S.O.P.) P.S. Case No. 119 of 2018, disclosing offences under Sections 341, 323, 325, 448, 379, 354(B), 504, 506, 307 and 34 of the Indian Penal Code. Allegation against the petitioner is of assault to the informant causing injury to him.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and petitioner and informant are agnates and although it is alleged that petitioner assaulted the informant, however, injury caused to him was found to be simple in nature.

Heard learned A.P.P. also.

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above

Patna High Court Cr.Misc. No.78108 of 2018(2) dt.04-01-2019 2/2 named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -I, Jhanjharpur, Madhubani, in connection with Lakhnour (R.S.O.P.)
