This application for grant of regular bail arises out of Excise Patna P.S. Case No.1393 of 2023 registered for the offence punishable under Sections 30(a), 32, 56(b) and 62 of the Bihar Prohibition & Excise Act, 2016 and Bihar Prohibition & Excise (Amendment) Act, 2022.

The police, on the basis of a secret information, raided a godown and recovered 36 litres of foreign liquor kept in a plastic bag and also arrested two persons. It is further alleged that on search, about 260 litres of foreign liquor

Patna High Court CR. MISC. No.71416 of 2023(2) dt.07-11-2023 2/2 and beers have been recovered.

The petitioners are in custody since 06.09.2023 and they have has clean antecedent. 5.

Considering the aforesaid facts, this application is allowed.

Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise-III, Patna, in connection with Excise Patna P.S. Case No. 1393 of 2023. 7.

This is subject to the condition that petitioners shall mark their attendance in Alamganj Police Station, District - Patna, on first Sunday of every month. Any default in appearance at the Police Station would result in cancellation of bail bonds of the petitioners. (Sandeep Kumar, J) pawan/- U T
