No-one appears on behalf of the State.

The petitioner apprehends his arrest in connection with Panjawara P.S. Case No. 08 of 2016 registered for the offences punishable under Sections 147, 148, 149, 341, 353, 379, and 201 of the Indian Penal Code.

Learned counsel for the petitioner submits that although in the F.I.R., his name has been placed as one of the accused, however, there is no allegation of either leading the mob or committing any overt act. Learned counsel further submits that the tractor in question does not belong to this petitioner and he had no reason to be a member of the mob as alleged. In the facts and circumstances of the case, let the petitioner namely Dipak Mandal, @ Pradip Kumar Mandal, in the event of his arrest/surrender before the court below within four weeks, from today, be enlarged on bail on furnishing his bail bonds in the sum of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Panjawara P.S. Case No. 08 of 2016, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. The petitioner shall immediately join investigation and shall report to the Investigating Officer within a week and thereafter as and when required to conclude the investigation at the earliest.
