JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-11-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 414 and 420 of the Indian Penal Code.

One stolen motorcycle is said to have been recovered from the house of the petitioner but according to prosecution case itself, the petitioner disclosed that he had purchased the said motorcycle from FIR named accused Rupesh Kumar @ Vivek Kumar. Admittedly, co-accused, Rupesh Kumar @ Vivek Kumar has already been granted privilege of bail by a coordinate Bench of this court vide order dated 18.10.2019 passed in Cr. Misc. No. 63607 of 2019.
