The petitioner seeks bail in Birpur P.S. Case No. 10 of 2015 registered under Sections 364, 302, 201 and 120B/34 of the Indian Penal Code.
As per the prosecution case, the son of the informant is said to have been taken away by the four named accused persons including the petitioner since then his son is traceless. It is submitted by learned counsel for the petitioner that from perusal of the F.I.R. it appears that informant is not the eye-witness of the occurrence. The name of the peitioner has surfaced only on suspicion and animosity. Similarly situated coaccused persons have been granted bail by co-ordinate Benches of this Court in Cr. Misc. No.29645 of 2015 vide order dated
Patna High Court Cr.Misc. No.38106 of 2017 (02) dt.10-08-2017 2/2 10.08.2015, Cr. Misc. Nos.24899 of 2015 and 35457 of 2015 vide order dated 02.09.2015, Cr. Misc. No.49264 of 2015 vide order dated 21.12.2015, Cr. Misc. No.56393 of 2015 vide order dated 16.12.2015 and Cr. Misc. No.7599 of 2016 vide order dated 18.02.2016. The petitioner has been languishing in custody since 07.05.2015.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st, Begusarai in connection with Birpur P.S. Case No.10 of 2015.
