JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-01-2019 This application, for grant of anticipatory bail, arises out of Dehri (T) P.S. Case No. 487 of 2018, disclosing offences under Sections 30 (a), 38(i)(ii), 41(i) (ii) of Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 576 canes of bear each containing 500 M.L. liquor from the Bolero Pick-up Van near the Panchayat Bhawan.

Submission of learned counsel for the petitioner that he has falsely been implicated in this case and nothing has been recovered from his conscious possession and he has been made accused only because his motorcycle was seized from the place of recovery. Further submission is that he has no criminal antecedent and has also not been named in the F.I.R. Heard learned A.P.P. also.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge - cum- Special Judge, Excise, Rohtas at Sasaram, in connection with Dehri (T) P.S. Case No. 487 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
