JUSTICE SANJAY PRIYA ORAL ORDER 09-08-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Mansi P.S. Case No. 94 of 2017 instituted for the offence under Section 394 of the Indian Penal Code.

It has been submitted that petitioner is not named in the First Information Report. The petitioner has no criminal antecedent.

From the written report it appears that Police on the basis of information given by spy, apprehended this petitioner and, thereafter, his confessional statement was recorded. It is mentioned in paragraphs- 16 and 17 of the case diary that on the basis of confessional statement, the looted motorcycle of the informant has been recovered from the field of one Ram Pukar

In this manner, there is no any recovery from conscious possession of this petitioner.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Mansi P.S. Case No. 94 of 2017, subject to the condition that both the bailors will be the close relatives of the petitioner.
