This application for grant of regular bail arises out of Mufassil P.S. Case No.912 of 2023 registered for the offence punishable under Sections 363, 366 and 376 of the Indian Penal Code and under Section 4/8 of the POCSO Act. 3.

The petitioner is alleged to have abducted the victim girl. The victim girl in her statement recorded under Section 164 of the Cr.P.C. has stated that she was having an affair with the petitioner, who is the devar of his elder sister and she had eloped with him. The petitioner is in custody since 27.08.2023 and he has clean antecedent.

Considering the aforesaid facts, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, POCSO Court-cum-Additional District & Sessions Judge, VI, Gaya, in connection with Muffasil P.S. Case No. 912 of 2023 subject to the condition that the petitioner shall cooperate in the trial.
