2. The petitioner seeks bail in connection with Deepnagar P.S. Case No. 314 of 2025 (G.R. No. 4230 of 2025) instituted for the offences under Sections 316(2), 303(2), 319(2), 318(4), 338, 336(3), 340(2), 61(2), 3(5) of the Bhartiya Nyaya Sanhita, 2023 and Sections 66(C), (D) of the I.T. Act.
3. As per prosecution case, the accusation against the accused persons including the petitioner is of misusing the internet to obtain loans from innocent people as also of committing cyber fraud in the name of Char Dham Yatra by helicopter.
4. Learned counsel for the petitioner submits that the

No.70627 of 2025(2) dt.08-10-2025 2/3 petitioner is innocent and has committed no offence as alleged against him and has falsely been implicated in the present case merely on the basis of suspicion and dirty village politics. Learned counsel for the petitioner further submits that no one has transferred money to the petitioner in the name of processing fee etc. either for obtaining loan or for Char Dham Yatra and, in absence of the same, no offence of cheating, forgery or conspiracy is made out against the petitioner. It is further submitted that in course of investigation, no one has claimed that the petitioner has cheated him and, thus, the petitioner has neither involved nor played any role in the alleged occurrence. He further submits that nothing incriminating has been recovered from the conscious possession of the petitioner or from his house. The petitioner has no criminal antecedent and is languishing in judicial custody since 19.07.2025 without any rhymes or reason.
5. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner, stating that the offence alleged is serious in nature.
6. Having heard rival contention of both the parties and considering the entire facts and circumstances of the case as also taking into account the period of custody of the petitioner

No.70627 of 2025(2) dt.08-10-2025 3/3 and the petitioner having no criminal antecedent, let the petitioner, abovenamed, be released on bail on furnishing bail bonds of Rs.15,000/- (Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Deepnagar P.S. Case No. 314 of 2025 (G.R. No. 4230 of 2025).
