JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-10-2019 This is an application for grant of anticipatory bail in connection with Barachatti (Mohanpur) P. S. Case No. 315 of 2019, disclosing offence under Section 30(d) of the Bihar Prohibition and Excise Act, 2016.
Police on information that some persons are selling Mahua in the forest, raided the place and recovered 350 kg of Mahua. As per F.I.R. petitioner and other accused persons succeeded in fleeing away. Apart from that petitioner is accused in three more cases.
Submission of the learned counsel for the petitioner is that except secret information, there is nothing against the petitioner.
Heard learned A.P.P. also.
Having heard both sides, considering the fact that
Patna High Court CR. MISC. No.64640 of 2019(2) dt.16-10-2019 2/2 petitioner is accused in three other cases of similar type, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, the same shall be considered on its own merit, without being prejudiced by order of this Court.
