====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 13-12-2018 Heard learned counsel for the petitioner and learned APP for the State.
Petitioner seeks bail in Muzaffarpur Rail P.S. Case No. 129 of 2018 instituted for the offence under Section(s) 419, 420, 414/34 Indian Penal Code and Sections 8 and 20 of NDPS Act.
In the written report it is alleged that four persons were apprehended from Wagon-R vehicle. It is further alleged that one Mobile phone and five small tablets have been recovered from possession of the petitioner.
The seizure list has been prepared. In the seizure list there is no description of the tablets alleged to be recovered from possession of the petitioner.
Patna High Court Cr.Misc. No.75005 of 2018(2) dt.13-12-2018 2/2 Petitioner is in custody since 21.7.2018 having clean antecedent.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge-cum-Speical Judge, NDPS Act, Muzaffarpur, in connection with Muzaffarpur Rail P.S. Case No. 129 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
