The petitioner apprehends his arrest in connection with Dariyapur P.S. Case No. 211 of 2019 registered for the offence punishable under Sections 272/273/34 of the Indian Penal Code read with Section 30(a)/38/41 of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the recoveries were from behind the shop of one Ram Chandra Singh and not from the conscious possession of the petitioner. Learned counsel for the petitioner further submits that the petitioner has no criminal antecedent.

In view of the aforementioned facts and

District and Sessions Judge XI, Saran at Chapra in connection with Dariyapur P.S. Case No. 211 of 2019, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
