The petitioner is apprehending his arrest in connection with R.P.F./Chapra P.S.Case no.917 of 2018 , registered for offences punishable under Sections 174 C and 153 of the Railway Act (arising out of Mufassil Non FIR No.917 of 2018 . Allegation against the petitioner is that he left the motorcycle at unmanned Railway Crossing.

Submission of the learned counsel for the petitioner is that the FIR is against the unknown and no other allegation has been attributed against the petitioner.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within

Patna High Court Cr.Misc. No.78593 of 2018(2) dt.10-01-2019 2/2 a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Railway, Sonepur District Saran in connection with R.A.F./Chapra P.S.Case No.917 of 2018 (arising out of Mufassil Non FIR No.917 of 2018), subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition to co-operate in the investigation..

With the aforesaid observation, this application is allowed.
