====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 13-07-2017 Heard the learned counsel for the petitioners. The petitioner seeks anticipatory bail in connection with Sitamarhi (Punaura P.S. Case No. 15 of 2017, registered for the offence punishable under Sections 341, 323, 324, 307, 385, 504/34 of the Indian Penal Code.

There is allegation levelled by the informant that while he was constructing a school through charitable trust, the petitioner along with others came and demanded a sum of Rs. 5,00,000/- and upon refusal of the same, the accused persons are said to have assaulted the informant.

The learned counsel for the petitioner submits that the petitioner is innocent, he has committed no offence and the offence alleged under Section 307 of the Indian Penal Code is not

Patna High Court Cr.Misc. No.32543 of 2017 (2) dt.13-07-2017 2/2 made out and the petitioner has a fair antecedent barring two cases wherein the police has submitted final form.

Having regard to the facts and circumstances of the case, I deem it fit and proper to grant anticipatory bail to the petitioner.

Accordingly, in the event of his arrest or surrender in the Court below within a period of four weeks from today, let the above named petitioner be enlarged on bail on furnishing bailbonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi, in connection with Sitamarhi (Purnaura) P.S. Case No. 15 of 2017 subject to the conditions laid down under Section 438(2) Cr. P. C. (Mohit Kumar Shah, J) BTiwary/- U T
