JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-04-2018 The petitioner is apprehending his arrest in connection with Beur P.S. Case No. 168/16, registered for offences punishable under Sections 304B/34 of the Indian Penal Code. Petitioner is husband of the deceased and allegation is of causing dowry death of the deceased.

It has been submitted on behalf of the petitioner that in fact the deceased was suffering from schizophrenia and earlier also she had attempted to commit suicide but her life was save and this time also she committed suicide but her life could not be save and it is the petitioner, who got her to hospital for treatment and she was alive for five days but thereafter she died. Heard learned A.P.P. also.

Having heard both sides, considering the facts and

Patna High Court Cr.Misc. No.13323 of 2018 (2) dt.05-04-2018 2/2 circumstances of the case and also the fact that the death of the deceased is due to asphyxia and petitioner is husband of the deceased, as such, I am not inclined to grant the privilege of anticipatory bail to the petitioner. This application is, accordingly, dismissed.
