The present application has been filed for transfer of Matrimonial Case No. 736 of 2015 pending in the Court of Principal Judge, Family Court, Patna to the Court of Principal Judge, Family Court, West Champaran, Bettiah. Learned counsel for the petitioner submits that the petitioner has a minor child and she is unable to go there and do pairvi in the case at Patna. It is further submitted that opposite party is a Scale -II Officer of the State Bank of India and he has been torturing the petitioner with demand of dowry. It is further submitted that since the petitioner has a small child and he is studying at Bettiah, it is not possible to go there and do pairvi in

Patna High Court MJC No.1922 of 2017 (7) dt.12-04-2018 the present case.

Having considered the entire facts and circumstances of the case and though the matter has been stiffly resisted by the sole opposite party, it is advisable and in the interest of justice, that the Matrimonial Case No. 736 of 2015 pending in the Court of Principal Judge, Family Court, Patna be transferred to the Court of Principal Judge, Family Court, West Champaran at Bettiah. It is directed accordingly.

Let the records of the aforementioned case be also transferred from the Principal Judge, Family Court, Patna to the Principal Judge, Family Court, West Champaran at Bettiah expeditiously.

No sooner the records are received, it is also directed that the Principal Judge, Family Court West Champaran at Bettiah shall take up the issue and decide the matter within a period of six months thereafter.

The M.J.C. application stands allowed. .
