02. 13.07.2017 Heard learned counsel for the petitioner and the State.
The petitioner seeks bail in a case registered for offences under Sections 272, 273 and 379 of the Indian Penal Code and Section 30(a) of the Bihar Excise & Prohibition Act, 2016.
As per allegation, 1700 pouch each containing 200 ML, i.e., total 340 litres of country-made liquor were recovered from the vehicle of the petitioner. It is contended that in fact the petitioner was not boarding at the Bolero vehicle at that point of time and false
Patna High Court Cr.Misc. No.32486 of 2017 (2) dt.13-07-2017 allegation has been leveled against the petitioner as he was lifted from his house which has been signed by the Mukhiya and Sarpanch of the village. Petitioner claims that he is having clean antecedent and is in custody since 04.06.2017. Having regard to the facts and the circumstances of the case, the petitioner, above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jamui in connection with Khaira P.S. Case No. 157 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
