JUSTICE SANJAY PRIYA ORAL ORDER 21-02-2018 This application has been filed for modification of the order dated 23.11.2017 passed in Cr. Misc. no. 55619 of 2017 by which petitioner was granted anticipatory bail. Learned counsel for the petitioner has submitted that prayer of the petitioner for anticipatory bail was allowed by order dated 23.11.2017 vide Cr. Misc. no. 55619 of 2017. It is further submitted that petitioner is working in Army and is posted in Kashmir. He, therefore, seeks modification in condition no.2 of the bail order that petitioner shall cooperate in the trial and shall be present on each and every date fixed by the court and absence on two consecutive dates without proper and reasonable reason, will automatically cancel bail bond of the petitioner.

Accordingly, the condition no.2 of the order dated

Patna High Court Cr.Misc. No.10240 of 2018(2) dt.21-02-2018 2/2 23.11.17 passed in Cr. Misc no. 55619 of 2017 is modified to the extent that petitioner may be represented by lawyer and as and when required by the Court below he will be physically present in Court.

This Cr. Misc. application is allowed.
