In this case, the petitioner is apprehending his arrest in connection with Sabour P.S. Case No. 69 of 2017 registered for offences under sections 447, 341, 323, 325, 307, 379, 504, 506/34 of the Indian Penal Code.

The petitioner and the Informant are own brothers. Allegation has been made that the petitioner and his two sons, in furtherance to assault the Informant, have entered into the house of the Informant, started abusing in filthy language, when they were prohibited, they started thrashing the Informant and his brothers Ramu Mandal and Pritam Kumar and they were also assaulted by the accused persons causing fracture in the hand.

Patna High Court Cr.Misc. No.34033 of 2017 (2) dt.31-07-2017 Learned counsel for the petitioner submits that the petitioner and the Informant are brothers, they have settled their score and has placed reliance on the order of this Court dated 13.7.2017 passed in Cr. Misc. No. 31587 of 2017. He further submits that the petitioner himself has also received minor injury. Looking to the entire facts and circumstances of the case, let the petitioner, namely, Kanhaiya @ Mrigendra Mandal, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, V, Bhagalpur in connection with Sabour P.S. Case No. 69 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
