In this case, the petitioner is apprehending his arrest in connection with Jagdishpur P.S. Case No. 207 of 2015 registered for offences under sections 302 of the Indian Penal Code and Section 27 of the Arms Act.
As per statement made in the First Information Report, in a dance programme, accused Vikash Singh, on some quarrel, fired at the head of the cousin of the Informant, as a result of which, he died.
After few months, the police has produced two witnesses, who gave out a different version of the incident alleging that three accused person, during dance programme, had scaled over the stage and, in the scuffle, Arjun Singh fired at
Patna High Court Cr.Misc. No.11906 of 2018(2) dt.27-02-2018 2/2 the deceased who died.
The statement in the First Information Report is different to the statement subsequently recorded by the police and the co-accused Mukesh, Singh having identical case, has been granted anticipatory bail by this Court vide order dated 17.9.2016 in Cr. Misc. No. 35488 of 2016.
Looking to the entire facts and circumstances of the case, let the petitioner, namely, Arjun Singh, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Ara in connection with Jagdishpur P.S. Case No. 207 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
