JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-11-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 272 and 273 of the Indian Penal Code and Section 30 of Bihar Prohibition and Excise Act. Some empty bottles of Indian foreign made liquor were recovered from beneath Gumti of petitioner for which the petitioner is in jail custody since 2.2.2019. Admittedly, the present case has been lodged only for the offences punishable under provisions of Bihar Prohibition and Excise (Amendment) Act, 2018.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above

Patna High Court CR. MISC. No.67163 of 2019(2) dt.04-11-2019 2/2 named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna, in connection with Special Case No. 1987/2019 arising out of Budha Colony P.S. Case No. 67/2019.
