The petitioner apprehends his arrest in Complaint case No. 872-C of 2014 for the offences allegedly committed by the petitioner under Section 147, 149, 379 of the Indian Penal Code.
The complainant named five persons in the complaint petition and alleged that the accused persons, who are officers of the S.T.F., recovered silver from his employees but showed recovery of only 13 kg. although the employees of complainant were carrying 41.450 kg. silver.
The learned counsel for the petitioner submits that petitioner is not named in the complaint petition. None of the witnesses of the complainant named the petitioner during the course of enquiry in their evidence. Thereafter, the complainant
Patna High Court Cr.Misc. No.34761 of 2017 (3) dt.17-08-2017 2/2 filed a petition and on such name of the petitioner has been inserted in the case.
Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner above named in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Railway, Bettiah, West Champaran in connection with Complaint case No. 872-C of 2014, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
