The petitioners apprehend their arrest in Belchhi P.S. Case No.44/2016, registered under Sections 147, 148, 149, 341, 323, 504, 353, 427 and 34 of the Indian Penal Code. Learned counsel for the petitioners submits that the petitioners are of course named in the F.I.R. but omnibus and general allegations have been made against them. The villagers made peaceful protest outside the police station against the high handedness of the police. It is further submitted that on similar allegation, many other accused persons who were named in the F.I.R. have been granted bail vide order passed in Cr. Misc.

Patna High Court Cr.Misc. No.11495 of 2018 (2) dt.27-02-2018 2/2 No.42961/2017, 59429/2017, 60668/2017 and 62347/2017. The case of the petitioners stands on same footing. Considering the facts that similarly situated other coaccused persons have already been granted bail, the petitioners above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Barh, in connection with Belchhi P.S. Case No.44 of 2016, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
