In this case, the petitioners are apprehending their arrest in connection with Dariyapur P.S. Case No. 67 of 2017 registered for offences under sections 147, 148, 149, 342, 380, 452, 506 and 307 of the Indian Penal Code.
Learned counsel for the petitioners submits that a criminal case as Dariyapur P.S. Case No. 220 of 2016 has been lodged by the present Complainant cum Informant and, later on, for the same incident, again a complaint case vide Complaint Case
Patna High Court Cr.Misc. No.33160 of 2017 (2) dt.21-07-2017 No. 2575 of 2016 was lodged which was sent to the concerned P.S. for registration and investigation of the case and the same was registered as Dariyapur P.S. Case No. 67 of 2017. Learned counsel for the petitioners submits that in the earlier police earlier police case, the petitioners are on bail. Let all these facts be examined by the court below and if it is found that the present case is arising from the same incident, in that case, let the petitioners, namely, 1. Arjun Manjhi alias Mangru Manjhi, 2. Manager Manjhi, 3. Sikandar Manjhi, 4. Rajnish Manjhi, 5. Usha Devi, 6. Baijainti Kumari, 7.Shiv Mangal Manjhi and 8.
Malti Devi, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, IV, Saran at Chapra in connection with Dariyapur P.S. Case No. 67 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
