2. The petitioner apprehends his arrest in the present case registered for offences under Sections 414 of the Indian Penal Code and Section 30(a), 32(2)(3), 36, 41(i)(ii) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, 3465 liters of illicit liquor have been recovered.

4. Learned counsel for the petitioner submits that petitioner is quite innocent and has not committed any offence. Petitioner claims clean antecedent. The petitioner was not caught on the spot and his name has transpired during investigation.

5. Learned APP for the State has vehemently opposed

6. Considering the fact that the petitioner was not caught on the spot and his name has transpired during investigation, this application for anticipatory bail is allowed.

7. Accordingly, let the petitioner, above-named, in the event of his arrest or surrender within four weeks from today in the Court below, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Exclusive Special Court, Patna City, Patna/concerned court below in connection with Agamkuan P.S. Case No.393 of 2023 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

8. This is also subject to condition that the petitioner will mark his attendance at the Mehandia Police Station on every Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
