The petitioner is apprehending his arrest in connection with Harsidhi P.S.Case No.206 of 2017 registered for offences punishable under Sections 341, 342, 447, 323, 324, 323, 379, 504, 506/34 of the Indian Penal Code.
Allegation against the petitioner is of assault to the informant and also committing theft of Rs.5,000/-. Submission of the learned counsel for the petitioner is that specific allegation is only against the petitioner nos.2 and 3 and there is general and omnibus allegation against the others. Further submission is that they were on police bail earlier.
Patna High Court Cr.Misc. No.23273 of 2018 (2) dt.19-04-2018 2/2 Heard learned A.P.P. and the learned counsel for the informant.
Having heard both sides and in view of the facts and circumstances, as stated above, as they were on police bail, let the petitioners surrender before the learned court below within a period of four weeks from the date of receipt of the order and make prayer for regular bail which will be considered on the basis of materials available on the record and also considering the fact that they were on police bail earlier.
