Petitioner is apprehending his arrest in connection with Barun PS Case No.86/2019 , registered for offences punishable under Sections 147, 149, 341, 323, 186, 333,379, 353, 307, 420, 411, 504, 506 and 427 of the Indian Penal Code and Section 4/40 (BMMCR) Bihar Minor Mineral Concession Rules, 1972 and Section 15 of the Environment Protection Act, 1986. As per FIR, there is allegation that the petitioner and several other accused persons assembled and protested the police party when they tried to stop lifting of the sand and also started brick-bating the police personnel.

Submission of the learned counsel for the petitioner is

Patna High Court CR. MISC. No.64792 of 2019(2) dt.16-10-2019 2/2 that except general and omnibus allegation, there is nothing against them and considering the same other co-accused persons have been granted anticipatory bail by Co-ordinate Bench of this court which will appear from Annexure 2 series. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Aurangabad in connection with Barun PS Case No.86 of 2019, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
