JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-02-2018 Heard learned counsel for the petitioners and the learned counsel for the State.

This application has been filed by the petitioners for modification in the order dated 18.12.2017 passed in Criminal Misc. No. 57727 of 2017 by this court with regard to extend the period of surrender of the petitioner in the court below. Learned counsel for the petitioner submits that vide order dated 18.12.2017 passed in Criminal Misc. No. 57727 of 2017, the petitioners were granted anticipatory bail, in the event of arrest or surrender before the court below, on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Bhagalpur, in connection with Sahkund (Sajour) P.S. Case No. 160 of 2017, subject to the conditions laid down under

Patna High Court Cr.Misc. No.11452 of 2018 (2) dt.28-02-2018 Section 438(2) Cr.P.C. But the petitioner could not surrender within the stipulated period due to personal difficulties. In that view of the matter, learned counsel for the petitioners prays for extension of period of surrender of the petitioners in the court below.

Considering the submission of the learned counsel for the petitioners, the period of surrender of the petitioners in connection with the aforesaid case in the court below is further extended for four weeks from today and this applications is, accordingly, allowed with the aforesaid modification in the order dated 18.12.2017 passed in Criminal Misc.
