This appeal has been filed for setting aside the order dated 2.6.2017 passed by 1st Additional Sessions Judge-cumSpecial Judge, SC/ST Act, Sitamarhi, in A.B.P. No. 730 of 2017/171 of 2017, arising out of Sursand P.S.case No. 208 of 2016 registered under Sections 363, 366A of the Indian Penal Code and 3(2)(v)(a) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act and for grant of pre-arrest bail to the appellant. Allegation against the appellant and other co-accused is of kidnapping the daughter of informant.
It has been submitted on behalf of the appellant that no specific allegation has been attributed against the appellant and
Patna High Court CR. APP (SJ) No.2092 of 2017 (2) dt.21-07-2017 2/2 she is a lady and has falsely been implicated in this case. Learned Special P.P. also.
Having heard both sides and in view of facts and circumstances, the appeal is not maintainable, as such, it is dismissed.
Let appellant surrender before the court of Special Judge and pray for regular bail, which shall be considered on the basis of submission, as above, and disposed of preferably on the same day, without being prejudiced by this order. (Vinod Kumar Sinha, J) spal/- U
