JUSTICE S. KUMAR ORAL ORDER 13-12-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner, who is in custody, seeks bail in connection with Kadwa P.S. Case No. 88 of 2017 registered for the offence punishable under Sections 302, 120B and 34 of the Indian Penal Code.

The allegation against the petitioner is of torturing and assaulting sister of the informant and as a result of said torture she died.

Learned counsel for the petitioner submitted that from the report of Viscera it appears that she died of poisoning and further submitted that she committed suicide by consuming sulfas. Petitioner is elder brother in law of deceased and it has further

No.35376 of 2017 (4) dt.13-12-2017 2/2 been submitted that one of the co-accused wife of petitioner has already been granted anticipatory bail by a coordinate Bench of this Court vide order dated 10.11.2017 passed in Cr.Misc. No. 52552 of 2017. It has further been submitted that petitioner has no criminal antecedent and he is in custody since 13.04.2017. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., IV, Katihar, in connection with Kadwa P.S. Case No. 88 of 2017.
