1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 363 and 366(A) of the Indian Penal Code.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that her daughter aged about 19 years on 11.06.2024 said that she was going to the kitchen and took her mobile, further at 4 A.M. the informant realized that her daughter is missing, thus started searching and realized that her daughter had taken her mobile also, further her another daughter received a call and the caller introduced himself as Amarjeet and disclosed that victim

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that petitioner is not named in the FIR and his name transpired during the course of investigation. It is next submitted that petitioner and victim were in love and they eloped and they also performed their marriage. It is next submitted that the informant herself in the FIR has disclosed the age of the victim as 19 years. It is also asserted and submitted that victim was a major on the date of occurrence. It is further submitted that victim came back and her statement was recorded under Section 183 BNSS, wherein she has not supported the case of the prosecution but then the learned court assessed her age as 16 years as such the petitioner apprehends his arrest. It is also submitted that victim presently is staying with the petitioner after marriage.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on

Case No.195/2024, subject to the conditions as laid down under Section 482(2) B.N.S.S.
