The petitioners apprehend their arrest in Sahebpur Kamal P.S. case No. 302 of 2017 under Section 493, 496, 315 of the Indian Penal Code.
The informant/ prosecutrix made allegation against Sudhir Kumar, son of petitioner No.1 and 2, and alleged that he, on the pretext of marriage, established physical relation with her. She was carrying pregnancy. Later on Sudhir Kumar caused her miscarriage and solemnized second marriage.
The learned counsel for the petitioners submits that petitioners are not named in the FIR. Later on name of the petitioners figured in the case.
Considering the facts aforesaid and the nature of
Patna High Court Cr.Misc. No.17772 of 2018 (2) dt.05-04-2018 2/2 allegation made against the petitioners, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Sahebpur Kamal P.S. case No. 302 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
