This application, for grant of anticipatory bail, arises out of Special Case No. 02 of 2015, (R.C. No. 06(A) of 2015) disclosing offences under Sections 120(B), 420, 468, 471 and 477A of the Indian Penal Code as well as Section 13(2) read with Section 13(1)(d) & (c) of Prevention of Corruption Act. Learned counsel for the petitioner has submitted that the petitioner, who happens to be a lady having clean antecedent, is innocent and has not committed any offence. In fact, the petitioner happens to be wife of Shrawan Kumar Chaudhary, the then Branch Manager of Oriental Bank of Commerce, Ara Branch, who is said to be the main accused and the entire F.I.R.
Patna High Court Cr.Misc. No.35933 of 2017 (8) dt.07-11-2017 revolves around him and he is said to have been in judicial custody. This petitioner has no role to play in the entire matter. The petitioner being the house wife is solely responsible for taking care of her minor son, who is aged about 7 years. Hence, the petitioner deserves the privilege of anticipatory bail. Considering the facts and circumstances of the case, let the petitioner, above named, in the event of her arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, C.B.I.-I, Patna, in connection with Special Case No. 02 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
