JUSTICE MOHIT KUMAR SHAH ORAL ORDER 26-06-2023 The present writ petition has been filed seeking the following relief:- "(i) For commanding the respondent authorities to dispose off the Encroachment Appeal No. 4 of 2018, pending before the Court of Learned Collector, East Chmaparan at Motihari as soon as possible in accordance with law in which the encroachment final order of removal of in Encroachment Case No. 5 of

Patna High Court CWJC No.17916 of 2022(2) dt.26-06-2023 2/2 2017-18 passed by the Circle Officer, Kalyanpur Circle, District - East Champaran against respondent no. 4 to 8 is under challenge.

(ii) Also for directing the respondent authorities to remove encroachment over Gairmajarua Sadak situated over the land appertaining to Khata No. 116, Kheshra No.

817 having an area of 1.48 acre, Mauza - Katharia, Thana No. 53, pursuant to the order dated 13.04.2018, passed in Encroachment Case No. 5 of 2017 - 18 by the Circle Officer, Kalyanpur."

The learned counsel for the petitioner submits that the District Magistrate, East Champaran has already passed the final order on 7th March, 2023, in Encroachment Appeal No.4 of 2018-19, hence he be directed to enforce the same. It is directed, accordingly.

The writ petition stands disposed off.
