The petitioners apprehend their arrest in connection with Hajipur Industrial Area P. S. Case No. 88 of 2015 instituted under Sections 147, 148, 149, 341, 323, 307, 353 and 427 of the Indian Penal Code.

The allegation, in brief, is that a large number of people protested and blocked the road on account of death of a lady in a road accident and also damaged vehicles of the passersby. Learned counsel for the petitioners submits that petitioner nos. 1 and 3 have already been arrested so anticipatory

Patna High Court Cr.Misc. No.37784 of 2017 (2) dt.11-08-2017 2/2 bail application on their behalf has become infructuous. Accordingly, anticipatory bail application on behalf of the petitioner nos. 1 and 3 is dismissed as having become infructuous.

It is submitted that petitioner no. 2 was onlooker in the crowd and in the alleged occurrence no one has sustained any injury and this petitioner has got no criminal antecedent. Having considered the aforesaid facts and circumstances, let the petitioner, namely, Saju Bhagat, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Industrial Area P.S.Case No. 88 of 2015; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
