2. The petitioner apprehends his arrest in a case registered for the offences punishable under Section 309 (4) of the BNS.
3. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and is a student. It is next submitted that in sum and substance the informant alleges that on 05.09.2024 while he was returning after collecting money, he was intercepted by three unknown accused on a motorcycle and they snatched Rs. 42,300/- from him on the point of gun and thereafter fled away. The Learned counsel submits that FIR was against unknown and the name of the petitioner transpires in the confessional statement of Gautam in
Patna High Court CR. MISC. No.69492 of 2025(2) dt.30-10-2025 2/3 police custody which does not have any evidentiary value.

It is also submitted that the motorcycle which was used in the occurrence was not registered in the name of the petitioner as would manifest from Annexure - 2 to the anticipatory bail application rather the motorcycle was registered in the name of Ram Mohan Yadav. It is next submitted that Gautam is a neighbour of the petitioner. It is further submitted that the motorcycle which was used in the offence is alleged to have been recovered from the door of the petitioner. It is submitted that Gautam is a neighbour of the petitioner and he had parked the motorcycle near the house of the petitioner. It is also submitted that it does not appear probable that had the petitioner been involved in the occurrence then he would have parked the motorcycle which was used in the offence in front of his gate and thus would have created evidence against himself. It is reiterated and submitted that petitioner is a student and will not abscond rather will co-operate in the investigation to prove his innocence.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the
Patna High Court CR. MISC. No.69492 of 2025(2) dt.30-10-2025 3/3 event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Saur Bazar P.S. Case No. 476 of 2024 subject to the conditions as laid down under Section 482 (2) of the BNSS.
7. One of the bailor of the petitioner shall be his father - Bhupendra Yadav. It is made clear that if the investigating officer of the case files an application before the learned Trial Court bringing to its notice that petitioner despite giving assurance to this court is not co-operating in the investigation in that event learned Trial Court shall be at liberty to cancel the bail bond of the petitioner.
