JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-11-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Petitioner is in jail custody since 30.8.2019 but according to prosecution case itself, neither the petitioner was caught on the spot nor anything was recovered from his conscious possession and petitioner does not have any criminal antecedents.

Accordingly, petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the
