2. The petitioner seeks bail, who is in custody since 06.06.2025 in connection with Majhauliya P.S. Case No. 258 of 2025, FIR dated 04.05.2025 registered for the offence under Sections 80(2), 238(a), 3(5) of the Bharatiya Nyay Sanhita, 2023.

3. According to the prosecution case, it is alleged that the petitioner along with other co-accused persons killed informant's sister due to non-fulfillment of demand of dowry and in order to destroy evidence, hide the dead body in a sack and buried it.

4. Learned counsel appearing for the petitioner

Patna High Court CR. MISC. No.69385 of 2025(7) dt.23-03-2026 2/2 submits that the petitioner has clean antecedent and he has falsely been implicated in this case. He further submits that informant is not the eye witness of the alleged occurrence and name of the petitioner has been transpired in this case merely on the basis of suspicion and the petitioner is rotting in judicial custody since 06.06.2025.

5. Learned A.P.P. for the State, on the other hand, has vehemently opposed the prayer for bail of the petitioner and submits that dead body of the victim was recovered from the spot where the petitioner had buried it and there were number of ante-mortem injuries was found on the person of the deceased and apart from that number of witnesses have supported the case of the prosecution.

6. Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail in connection with Majhauliya P.S. Case No. 258 of 2025, pending in the Court of Chief Judicial Magistrate, Bettiah, West Champaran.

7. Prayer is refused.
