JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 10-08-2017 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is seeking regular bail in Danapur R.P.F. P.S. Case No. 02 of 2017 registered under Section 3 RP (UP) Act. Learned counsel for the petitioner submits that in the First Information Report there is an allegation of commission of theft against the unknown persons. One Ajit Kumar was apprehended by police who, in his confessional statement, named this petitioner. Learned counsel further submits that there is no recovery of any stolen property from this petitioner and said Ajit Kumar has already been granted regular bail by a co-ordinate bench of this Court in Cr. Misc. No. 24026/2017. Learned A.P.P. for the State opposed the prayer for bail.
