This is an application for bail in connection with Shankarpur P.S.Case No. 127 of 2016, corresponding to POCSO Special Case No. 03 of 2017, registered for the offences punishable under Sections 341, 342, 452, 354, 454A, 354B, 366, 380, 420, 504, 506, 509/34 of the Indian Penal Code and 8 of POCSO Act.
Earlier prayer for bail of the petitioner has been rejected by this Court by order dated 17.4.2017 passed in Cr.Misc.No. 17239 of 2017.
It has been submitted on behalf of the petitioner that this application has been filed for grant of bail on the ground that other co-accused persons have been granted bail and petitioner is rotting in jail for about five months.
Patna High Court Cr.Misc. No.35165 of 2017 (2) dt.26-07-2017 2/2 Heard learned APP also.
Having heard both sides and in view of the fact that prayer for bail of the petitioner has earlier been rejected, I am not inclined to grant bail to the petitioner. Prayer for bail is again rejected.
However, learned trial court is directed to conclude the trial within six months. If trial is not concluded within the said period, petitioner may renew his prayer for bail. With the above observation, this application is dismissed.
