JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Ahiyapur P.S. Case No.458/2019 registered for the offence punishable under Sections 406, 420 and 34 IPC and 138 NI Act.

As per FIR, there is agreement between the son of the informant and the informant with respect to sale of the land for which the petitioner has paid twenty two lacs and thirty five thousand to the petitioner. Both the lands were received by the son of the petitioner but in respect accused persons sold and later on a cheque was issued by the petitioner. Submission of learned counsel for the petitioner is that FIR itself has been taken by the son of the petitioner and the issue concerned after kidnapping the son of the petitioner. Petitioner was issued a cheque.

Considering the facts as stated above I also considering the fact that petitioner was old lady aged about 72 years let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/-(Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the CJM, Muzaffarpur in connection with Ahiyapur P.S. Case No.458/2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the court concerned and cooperate in the case and appear before the lower court as and when required.
