JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 06.04.2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Baisi P. S. case no. 245/2017 registered under sections 420, 120B of the IPC and 7 of the E.C. Act.
One truck laden with rice was intercepted and driver of the aforesaid truck was arrested. However, on verification, it was found that bags of rice contain FCI mark and on the basis of the aforesaid mark, the informant lodged the present case with allegation that FIR named accused were selling rice of FCI in black market.
Submission on behalf of the petitioner is that petitioner happens to be owner of the truck and the

No.14323 of 2018 (2) dt.06-04-2018 petitioner has no concern with the rice and moreover, owner of the rice mill, namely, Yuvraj Bhagat has already been granted privilege of bail by a coordinate bench of this court. Considering the aforesaid facts and circumstances as well as submissions of the parties, it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Purnea in Baisi P. S. case no. 245/2017 subject to condition as laid down under section 438(2) of the Cr.P.C.
