In this case, the petitioner is seeking anticipatory bail in connection with Madhuban P.S. Case No.335 of 2017, registered for the offence punishable under Sections 406, 420, 504 and 506 of the Indian Penal Code.
The petitioner is the son-in-law of the informant. It is alleged by the informant that he has given his firm to the petitioner to run the business and after earning profit, the petitioner will have to pay Rs.2 lakhs per year. The petitioner has paid the said amount for two years, but thereafter he has refused to pay the money and even after repeated demand, the petitioner has not paid the same. At the same time, the petitioner used to hurl threat for dire consequence.
Patna High Court Cr.Misc. No.19123 of 2018(2) dt.06-04-2018 2/2 As it is a relationship between the father-in-law and son-in-law, for certain period the money was given to the informant. Basically, it is a civil dispute.
Looking to the facts and circumstances of the case, let the petitioner, namely, Mahammad Rijwan Ansari @ Rustam, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-IV, East Champaran, in connection with Madhuban P.S. Case no.335 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
